PLEASE READ THESE TERMS CAREFULLY AS THEY AFFECT YOUR LEGAL RIGHTS. BY ACCESSING THE PLATFORM, USING THE SERVICES OR COMPLETING A PURCHASE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, PLEASE DISCONTINUE USING THE PLATFORM.

These Terms of Service ("Terms") are a binding agreement between you ("User", "You" or "Your") and RoameSIM concerning your access to and use of our prepaid travel eSIM services via our website at roamesim.io and related features (collectively, the "Platform").

1. Description of Services

RoameSIM enables you to purchase, download and use prepaid mobile data plans delivered via embedded SIM (eSIM) technology through our Platform. Plans are resold through authorised wholesale partners and local mobile operators.

We provide the Service on an "as-is" and "as-available" basis, without warranties of uninterrupted availability, performance or fitness for any particular purpose, to the fullest extent permitted by law.

Payments are processed securely through Stripe. All prices are expressed and charged in US dollars (USD). Prices shown in other currencies are indicative conversions for reference only.

RoameSIM does not provide voice calling or SMS messaging. We do not guarantee network availability, coverage or performance in any specific location. Where plans are provided by third-party carriers, RoameSIM acts as a reseller and technical intermediary and is not a party to the contract between you and the underlying network operator.

2. Your Representations

By using RoameSIM, you represent and warrant that:

• you are at least eighteen (18) years old;
• you will comply with all applicable laws and regulations;
• all information you provide is true, accurate and current;
• you will not use the Platform for unlawful, abusive or fraudulent purposes; and
• you will not infringe the intellectual property or other rights of RoameSIM or any third party.

We may suspend or refuse service if you breach these representations or if we determine you are not eligible to use the Services.

3. Purchase, Payment and Activation

Purchases on our website are one-off prepaid packages. By completing checkout, you enter into a binding sales agreement governed by these Terms and our Purchase Policy.

We do not store payment card details. All financial data is processed by Stripe. You authorise us and our payment processors to charge the applicable fees, including taxes where required.

After purchase, you must install and activate the eSIM on a carrier-unlocked, eSIM-compatible device with a stable internet connection. You are solely responsible for correct installation and activation.

Refunds, cancellations and price changes are governed by our Purchase Policy and Refund Policy.

4. Device Compatibility

You must verify that your device supports eSIM and is carrier-unlocked before purchase. Compatibility tools and device lists are provided on the Platform for guidance but may not be exhaustive. RoameSIM accepts no liability for failed activations caused by incompatible or locked devices.

5. Delivery

eSIMs are delivered electronically within minutes of successful payment. The QR code is sent to your email address and is also available via your private order tracking link. Installation guides are provided on the Platform and in delivery emails.

6. Start, Duration and Termination

The service begins when you complete your purchase. The duration depends on the validity period and data allowance of the package purchased. The service ends when data is exhausted, the validity period expires, or the eSIM is removed from your device. We may modify, suspend or discontinue any aspect of the Platform at our discretion, with notice where reasonably practicable.

7. Code of Conduct

The Platform is for personal, non-commercial use only. You must not:

• use the Services in violation of applicable law;
• attempt unauthorised access to our systems or other users' data;
• use automated tools to scrape or overload the Platform;
• reverse engineer, copy or commercially exploit any part of the Platform; or
• engage in abusive, fraudulent or network-damaging activity.

Violation may result in suspension of service without refund.

8. Intellectual Property

All content on the Platform — including text, graphics, logos, software and design — is owned by or licensed to RoameSIM and protected by intellectual property laws. You may not copy, reproduce or exploit any part of the Platform without our prior written consent.

9. Privacy

Our collection and use of personal data is described in our Privacy Policy. By using the Platform, you acknowledge that you have read it.

10. Disclaimer of Warranties

YOUR USE OF OUR SERVICES IS AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, ROAMESIM DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION, OR COMPATIBILITY WITH YOUR DEVICE OR NETWORK ENVIRONMENT.

11. Limitation of Liability

To the fullest extent permitted by law, RoameSIM shall not be liable for any indirect, incidental, special or consequential damages arising from your use of the Services.

Our total aggregate liability for any claim relating to these Terms or the Services shall not exceed the greater of (a) the amount you paid to RoameSIM for the specific service giving rise to the claim in the one (1) month preceding the claim, or (b) five hundred US dollars (USD 500).

12. Force Majeure

We shall not be liable for any failure or delay caused by events beyond our reasonable control, including natural disasters, war, labour disputes, government actions, infrastructure failures or carrier outages.

13. Applicable Law

These Terms are governed by the laws of England and Wales. Any dispute shall be subject to the exclusive jurisdiction of the courts of England and Wales, unless mandatory consumer protection laws in your country require otherwise.

14. Changes to these Terms

We may amend these Terms at any time. The latest version published on the Platform applies to all users. Your continued use after changes constitutes acceptance.
